Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the websites, applications, APIs, documentation, and related services offered by eighty6data ("eighty6data," "we," "us," or "our"), including without limitation the site at https://www.eighty6data.com/ and related domains (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who we are
eighty6data provides tools to query labor and industry statistics, including through a web-based explorer and a subscription REST API. Public data sources underlying certain datasets are attributed in our API responses and documentation.
If you access the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.
The Service
The Service may include: (a) marketing and account pages on eighty6data.com; (b) an interactive data explorer and related downloads where offered; (c) authenticated REST API access for subscribers; (d) API keys and usage limits as described in your plan or the documentation; and (e) support channels we make available.
We may add, change, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.
Eligibility and accounts
You must be at least eighteen (18) years old and able to form a binding contract to create an account or subscribe to paid plans.
You are responsible for safeguarding your credentials and API keys. You must notify us promptly of unauthorized use. You are responsible for activity under your account except where caused by our gross negligence.
Subscriptions, billing, and taxes
Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe, unless otherwise stated at checkout. By subscribing, you authorize us and Stripe to charge your payment method for applicable fees and taxes.
You may cancel through the billing management tools we provide (for example, the customer billing portal). Cancellation stops future renewals; you generally retain access through the end of the current paid period unless we state otherwise.
Fees are non-refundable except where required by law or expressly stated at purchase. We may change pricing with reasonable advance notice; changes apply to subsequent renewal periods.
If payment fails, we may suspend or downgrade access until payment succeeds.
API use, rate limits, and fair use
API access is subject to authentication, rate limits, row limits, date-range limits, and other technical restrictions described in your plan, the documentation, or API responses. You must not circumvent or interfere with those limits or security controls.
You must use API keys only for your own integrations unless we agree otherwise in writing. You may not share keys in public repositories, client-side code, or other exposed locations.
Acceptable use
You agree not to:
- Use the Service in violation of law or third-party rights.
- Probe, scan, or test the vulnerability of our systems without authorization, or breach or circumvent security measures.
- Overload, flood, or attempt to disrupt the Service (for example, denial-of-service attacks) or impose an unreasonable load inconsistent with normal use.
- Use the Service to distribute malware, phishing, spam, or deceptive content.
- Reverse engineer our proprietary software except to the limited extent permitted by applicable law despite this restriction.
- Resell or redistribute the Service itself (as opposed to insights or derivative work products you create) without our written consent.
Intellectual property
The Service, including our software, branding, documentation layout, and non-public compilation and presentation of data, is owned by eighty6data or our licensors and is protected by intellectual property laws.
Datasets may incorporate or derive from public government releases. Your rights in those underlying facts or official releases are governed by the applicable source licenses and law. Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable right to access and use the Service and to use API responses for your internal business or research purposes and to create derivative analyses, visualizations, and applications, in each case in compliance with law and these Terms.
Third-party data and disclaimers
Labor and industry statistics may be sourced from or aligned with public releases (for example, Bureau of Labor Statistics Quarterly Census of Employment and Wages-style series). eighty6data is not endorsed by or affiliated with the U.S. Bureau of Labor Statistics or other government agencies unless we expressly state otherwise.
Data may be processed, enriched, reformatted, or cached. THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATA IS COMPLETE, TIMELY, ERROR-FREE, OR SUITABLE FOR REGULATORY FILINGS, LITIGATION, OR ANY HIGH-RISK USE. YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE OUTPUTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL EIGHTY6DATA OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT HAD A PAYMENT OBLIGATION.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
Indemnity
You will defend, indemnify, and hold harmless eighty6data and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content or applications built on the Service, or your violation of these Terms or law, except to the extent caused by our willful misconduct.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we are required to do so by law.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
Export and sanctions
You represent that you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. You will comply with applicable export and sanctions laws.
Governing law and disputes
These Terms are governed by the laws of the State of New York and the federal laws of the United States, without regard to conflict-of-law principles that would require application of another jurisdiction's laws.
You and we agree that the state and federal courts located in New York County, New York will have exclusive jurisdiction for disputes arising out of these Terms or the Service, and you consent to personal jurisdiction there. If you are a consumer, mandatory consumer protections in your country of residence may still apply.
Changes
We may update these Terms from time to time. We will post the updated Terms on the Service and update the "Last updated" date. If a change is material, we will provide additional notice (for example, by email or a prominent notice in the product). Your continued use after the effective date constitutes acceptance of the revised Terms.
Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements on the subject.
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
